Federal Express Entry EE

 

The Department of Immigration, Refugees and Citizenship of Canada (IRCC) have announced the new changes to the Federal Express Entry –EE (Express Entry-EE) effective November 19, 2016. The changes are as follows:

  1. After the applicant receives the Invitation to Apply from EE, the deadline for submitting the application online has changed from original 60 days to 90 days.

This changes were made for applicants that were unable to provide all immigration documents within 60 days which resulted in delays or rejection of their application. Because the acquisition of a criminal record certificate and the applicant’s academic certification in some countries takes more than two months, applicant then has to apply to IRCC for an extension and provide a convincing reason for the extension. This will be more beneficial to applicants after changing to 90 days.

  1. The labor market impact assessment (Labour Market Impact Assessment-LIMA) reduced the score, and the employer arranges employment (offer of Arranged Employment-OAE) changed.

Applicants will not get 600 points from LMIA. LMIA is a way for Canadian government to certify OAE. Starting November 19 of this year, LMIA can only provide applicants with (1) 200 points +, if the applicant’s position belongs to the Canadian National Occupation Classification NOC 00, that is, senior management position; (2) 50 points +, if the applicant’s position falls under other categories.

In addition, OAE certification requirements has lessen. The following applicants will no longer need the employer’s LMIA to earn extra points: (1) applicants who currently holds a valid work permit, which was issued based on the previous LMIA by the employer. The applicant must hold a permanent employment contract from the employer; or (2) applicant currently hold a valid work permit that belongs to the LMIA exempt category, yet the employer is specified on the work permit. The applicant must have worked full-time continuously for the employer for more than one year, or a part-time job equivalent to one year of full-time work, and also holds a permanent employment contract from the employer. Case (2) applies to intra-company transferees of multinational companies, NAFTA professionals and others under the North American Free Trade Agreement. But for international students, due to their open work permit (Post Graduate Work Permit-PGWP) obtained after graduation does not specified the employer, it will not be applied in this situation. Hopefully in the near future IRCC can further clarify the categories of PGWP.

 

  1. Work Experience in Canada, should be remunerated by the payment of wages or commission, income should include two parts (wages and commission).

Work experience without paid in Canada will not be eligible. Canadian work experience must come from a position stated under the Canadian national occupational category 0, A or B. It can be either full-time or part-time.

The clarification of the commission is beneficial to the applicant. The IRCC immigration officers excluded commission when processing applications, resulting in applicants unable to reach the average income value of the claimed occupational category in Canada, and they were claimed not having any work experience at all in Canada.

On June 28th, Ontario invited applicants whose occupations were in the computer category and with an EE scores under 400 points to test the water. This week on (July 04) Ontario announced the specific NOC code for ICT applicants. ICT is Information and communication technology which means your occupation must related to computer information!

Ontario announced the latest policy for the EE project nominated by the province: an invitation targeted to IT-oriented occupations. Which means if you meet the following criteria and also the federal 67 entry threshold, you can be nominated by Ontario. The occupation list are below:

Or simply search for Ontario’s skilled immigration EE program is a bit different than in the other provinces. You do not have to go to the Provincial Immigration Bureau (such as Saskatchewan or New Province) to apply. Ontario government will directly select people from the federal EE pool. The Selection criteria are:

The requirement of 400 score points is lower than the federal EE score requirement. However, for the overseas applicants to achieve this 400 score points, they will need IELTS 7778. Unfortunately, this 400 score points is the threshold according to the EE scoring rules. IELTS 7778 and IELTS 6666 are in two completely different levels. That said, this new policy of provincial nomination for IT-related occupations applicants is very beneficial for those who would like to apply. As long as those applicants are in these occupations categories, they do not need to reach 400 points, which means they do not need IELTS 7778. They only need IELTS 6666, a bachelor degree or above, more than one year of relevant experience, and a federal skilled immigration score of 67.
